IL red light law passed

Hi All,

Being a member of LocalMotoHub.com, I received their news letter which had an update on the IL red light law that just passed. Here's a brief article about it from

Illinois Law Change - Motorcycles and Red Lights

This is in regards to traffic actuated signals (red light sensors). Often times, these signals do not pick up on motorcycles, scooters, or mopeds because they either do not weigh enough, or do not have enough metal to trigger the sensors.

Here is the language:

3.5. After stopping as required by paragraph 1 or 2 of this subsection, the driver of a motorcycle or bicycle, facing a steady red signal which fails to change to a green signal within a reasonable period of time because of a signal malfunction or because the signal has failed to detect the arrival of the motorcycle or bicycle due to the vehicle's size or weight, shall have the right to proceed subject to the rules applicable after making a stop at a stop sign as required by Section 11-1204 of this Code.


Finally, some really good legislation!

Good news for you folks out there, just wonder what, "change to a green signal within a reasonable period of time" will mean to you vs the Leo's.

IIRC, the LocalMotoHub.com news letter mentioned 120 seconds. I certainly will still have
my head on a swivel looking for Mr LEO as I have had to do many times in the past.
There's a light near my house that has been a problem. I've brought it up with the local
highway commissioner. He said it tests fine. Oh, well. Maybe he tested with a bike with
more metal my plasticized LT.

One train of thought on that subject was that the lights went through one cycle without allowing you to move.

example: Intersection where oncoming traffic is allowed to proceed with left turn signal and your light never changes.

Again you are subject to what "Officer friendly" sees the moment he rounds the corner or crests the hill to see you running a red light.

I have run the red light in front of the local state LEO station several times under the above circumstances. I always proceed with caution and never act like I am intentionally blowing the light by rapid acceleration etc.

knock on wood, no tickets or discussions with LEO's yet.

The Dead Red Bill is Law! Effective Jan. 1 motorcycle riders in Illinois may treat extended red lights or left-turn arrows as four-way stops except for lights controlled by a timer. The law does not specifiy how long the rider must wait before proceeding through the intersection but obviously there must be a clear path. Pending is Senate Bill 2528, which would require riders to wait 120 seconds before proceeding through a clear intersection. Excluded are municipalities with populations of 2 million and over.
