5 years for killing motorcyclist?

It doesn't matter if the victim was a motorcyclist or driver of a land yacht, the fact is the accused was grossly negligent and California jails are overcrowded, so she'll never serve anything close to what she should have received for sentence.

Such tragedies due to texting and cellphone usage while driving just doesn't get the attention like drunk driving. You don't see MADD chasing these perpetrators, yet studies conclude drivers on cellphones are often worse than drunks behind the wheel.

America will have these double standards until we decide to outlaw such irresponsible acts.

So, does this mean one more strike and she's out, or do they still have that in Ca.? or what this crime not horrific enough?

You know, the Middle Eastern cultures and others similar who practice "an eye for an eye" might have it right. While it sounds cruel and barbaric, it is actually a great deterrent, but then, they probably don't have a lot of bleeding heart liberals like Maxine Waters, Barbara Boxer, and Nancy Pelosi.

Not bragging, so don't get me wrong here, but I spent 26 years with the Oregon State Police, about 20 of those years doing fatal collision and crime scene reconstruction. I've seen my share. But my point is, that if you're looking for the guy who could put a bullet in the heads of some of these pieces of chit, I'm your man. I'll even buy the bullets.
Guess why I like my dogs, cats, deer and horses more than my neighbors.
There, I feel much better now.

I had seen something a couple of years ago that said a DUI driver (up to a point) is actually a safer driver than a texting driver. The study showed that the DUI driver concentrated more on driving (as to not get caught) while the texting driver was unattentive, eyes off road and more concentrated on texting than driving.

Just read the April issue of Motorcycle Consumer News and there is an article with the title of "Kill A Biker, Get A Ticket" which had numerous examples of the sad reality that if you are riding a motorcycle and get maimed or killed by a car driver most jury members (almost certainly all car drivers) will identify with the car driver and assume that you purposely placed yourself in harm's way by choosing to ride a bike.

As motorcyclists, we all know the dangers & risks we expose ourselves to. Because of that most of us AGATT and take other proactive safety measures.

All these real life examples are "in your face" of the fragility of this journey called "Life" - tell those you Love just that, every chance you can and do those things that bring Others and yourself Joy whatever that may be.

Wyoming passed the no texting while driving last July.........The fines are quite substantial. Many of the communities now have 'Hands free onlly' cell phone laws while driving.

There have been many close calls for me prior to the passing of those laws, and not just while up on two wheels. I know there is a lot of talk about it on the national level, which I do not agree with, but on a state by state basis, I am all for them.

Yup, this ^^^

We had a firefighter killed just last week. Sixteen year old girl turned left in front of him and a buddy....because she wanted to make the light. Some of the water cooler discussion had that "well, those motorcycles are hard to see" tone.

I "explained it" to them.

There has been a lot of folks killed by dumb a** drivers. I think this last year, the bumper sticker of the year ..........that being the one I revert to most often, read, "Put the cell phone down and concentrate on your shitty driving"...........(now that was in a quote, and I hope the monitors don't shut me down,).

I was thinking of ordering a couple of hundred.................

I'm thinking this is starting to be the de facto answer- kinda like pleading insanity for murder or some other hideous crime whenever people don't want to take responsibility for their actions and stand accountable.

Either that, or each time someone spouts this, they're admitting they're one of the crappy drivers (who doesn't need to be on the road in the first place) we're constantly on the lookout for.

As someone else said, most jurors are just cage drivers, so it's easy to use this excuse and gain sympathy, especially when we see so many Evil Knievels are our public roads giving all of us a bad rap.

I'm guessing it could have been a Mack truck instead of this poor biker, and this habitual offender wouldn't have seen it either.
