New Speeding Defense?

Ohio Court of Appeals rules that a police officer cannot issue a speeding ticket because a car sounds fast.

I find it interesting that they did get radar data showing that he was speeding, but once that was thrown out due to a technicality they appealed against the officer's discretionary abilities and won.

Nah, that just means we should all buy louder-than-stock pipes and drive at the speed limit, or even 5 under. Maybe even add some chrome bits to confuse the visual clues as well.

It's ridiculous that he got a ticket for 7 mph over the limit, a warning maybe but not a ticket.
No wonder the guy fought it.

Yeah, and drive around in 1st and 2nd gear so you sound really fast when you're going slow.

I wonder how much it cost that Frietag guy to go through all the court appeals vs. just paying the fine?

That's my consensus too, Ken. Of course I don't get speeding tickets like I did in the days of my youth, but I never did sweat the 1st one. 2nd one made me real nervous. Never did get a 3rd one. In Illinois you used to be able to go to a class after a ticket and it would be suspended if you didn't get another one for 6 or 12 months. Don't remember which. In fact, I think they did away with that a year or so ago. But if would definitely be worth fighting the last one if it meant losing you license for a year. Not to mention what it does to your insurance...
At one time I had a 900 Kaw & a Datsun 280Z. I had to drive properly for nine months one time on 2 tickets. Ugh!

Well, with 40K miles this year alone, let's just say I've had plenty of "opportunities" to gather points.

Here in CA it used to be that traffic school was cheaper than the ticket, then you didn't have to pay the fine or take the points. I got pulled a while back on a local street, in the 35 mph section right before it upped to 50 mph. Nice LEO on an RT-P who was very interested in my GT for almost 20 minutes. When I got the paperwork in the mail, the fine was $350 so I went to court and got a trial date. The LEO showed, a little annoyed that I had gone to court even though he had "cut me a break" and he was well prepared so I was basically done for. When I told him the fine was $350 even the LEO was surprised.

My case was delayed until after lunch and the LEO and I had a nice chat while waiting to go back in. When the judge called us forward, the LEO simply said he was dropping the ticket. He did warn me that he patrols that section of road a lot (big city money maker), but he let me off. Whew.

Great job, Ken! You handled it perfectly. Half of the time, the officer doesn't even show up, anyway. Even if he does, you can always plead guilty (if said citation was legit), and ask for leniency on the fine. I can't even begin to tell you how many times I've seen a judge suspend the fine OR cut it in half, just for the asking!
