Three Dead after Pickup Slams into Rally Riders

Why is this guy not in jail?!?!?!

The initial release of this story seemed innocent enough, 9:30AM Pickup-Motorcycle crash on a rural two-lane road.

Check the "inventory" found in the truck. Obviously, everyone in this country is innocent until proven guilty - and the toxicology reports are yet to be completed - but come on - he killed three motorcyclists and is not in jail.

At best this is an individual with a MAJOR consumption problem:
8 - 20 mg. Oxycontin since July 8
16 - 10 mg. Diazapam since July 1
114 - Hydrocodone since July 1
27 - 40 mg. Oxycontin since July 1

Also found in the truck - two bags of green leafy material and the State Trooper reported the strong smell of marijuana in the truck immediately after the wreck.

No further charges??????????????? What the hell is going on??????????????

As a traffic homicide investigator you want to get all the pieces to the puzzle before you make your charges. If you put a person in jail on a weak probable cause, you could lose your whole case.

Also speedy trial starts and you make a charge and something else pops ie in the search warrant, they person could already have plead to something lower and you could add the stronger evidence on that person.

Me too (long ago) and what John says is spot on (first ppg). But then I think he musta been pulling an all nighter when he wrote 2nd ppg.. I think he was trying to say "If you charge too low, they can plead guilty real quick like and then you can't charge the higher charge because of double jeopardy (not the game show either.)"

Let's give them a chance to put together a good case and then when they plead Man One down to Careless Driving, we can go ape s**t over it.

The article states "So far, no further charges....." which clearly indicates that there is still an investigation going on. I would expect that charges will eventually be laid if the police are able to make a case. We should save our anger until the investigation is complete. The guy might have been impaired, and if so they should throw the book at him. However, there is also the chance that, despite the presence of drugs and grass, he was not impaired. Let the police do their work. I am sure they just want to make a strong case so the guy does not get off lightly, if he is in fact guilty.

Even if he proves to have not been impaired the guy was driving on the wrong side of the road when he killed the riders. Isn't there a chargeable offense in there somewhere.

Negligent and crappy driving in the first degree?

Inattentive driving resulting in a death?

COrsicana Sun News regarding the Accident

They took the guys blood samples from the HOspital, So the DPS is working on getting its ducks in a row for this guy. That is the latest.

Corsicana Sun, although they are just reporting the news, the community is outraged about this as they lost some really good commumity members and that does not set well. thank goodness for that.

It seems this person was a loaded weapon that finally went off...

Adding insult to injury - Our terminally stupid Texas governor, Prick Perry, vetoed a bill last week that would have a instuituted criminal penalties for drivers that were passing less than 3 feet from "vulnerable road users" - bicyclists, pedestrians, wheelchairs, and MOTORCYCLES. Althought the bill would not have applied in this case, it's a clear example of some of the outrageous stances being exhibited by powerful people when it comes to supportive legislation for anybody except those in cars.

There was 94% public support of the bill, and it passed the senate with 0 opposed, and the house with only 5 (of 135) opposed. This in a state where over 1000 "vunerable road users" were killed last year.

I hope the fine folks in Corsicana "hang 'em high". If he was "impaired" and it can be proven the excess of drugs were for distribution, then perhaps they can charge him with taking a life during the commission of a felony - punishable by the death penalty in our great state.

I know there has been a time or two I have wanted to run over a bicyclist myself and Gov. Perry rides (then falls off) bicycles too, so the fact that they are still fair game could be a good thing.

....The affidavit also quotes Lindsey as saying he had been taking pain medications so long that he was addicted to them and that if he did not have them to take “other things would happen.....”
In a separate statement, DPS, pronounced "DiPS," announced that the sun WOULD rise in the morning.....Unless Lindsey doesn't get his dope.....Then the sun would fall out of the sky!

Now guys, how about a 10 day waiting period on 3 ton cruise missiles?
