CHARLESTON, W.Va. (WSAZ) -- As if getting a DUI wasn’t enough, a man arrested for driving under the influence got in a lot more trouble at the police station.

Police stopped Jose Cruz on Route 60 in South Charleston Monday night for driving with his headlights off.

Then, he failed sobriety tests and was arrested.

The investigating officer remarked in the criminal complaint that the odor was very strong.

Cruz is now charged with battery on a police officer, as well as DUI and obstruction.

There are a few folks at work who have lethal "odour".

And don't get me start about my wife's silent-but-deadly eminations....

So, if you had irritable bowel syndrome -- or even a growling stomach -- could you be charged with "menacing"? Come on, the guy was drunk and farted near/on/at the officer. <edit: I re-read the article and understand the guy actually fanned the flatulence towards the officer.> Where does this end? Drunk or not, the guy is rude and disrespectful at the least, but a chargeable offense...?

No disrespect intended towards LEOs, just wondering.

My son passed gas twice on the way to school this morning, I thougth it was rude, I guess it was much more, it was againts the law. I should've kicked his ass.
