Clay County authorities on Tuesday charged a 17-year-old who was shot in the head after he allegedly tried to rob a couple Saturday at a Northland automated-teller machine.

Christian D. Johnson of Gladstone was charged with attempted first-degree robbery. He was also charged with first-degree robbery in connection with a separate holdup at a convenience store earlier Saturday.

The bond for Johnson, who remained hospitalized Tuesday, was set at $100,000.

According to court records, the attempted robbery at the ATM occurred about 9 a.m. Saturday. Johnson was shot in the head by his alleged intended victim outside a Bank of America at North Oak Trafficway and Barry Road.

Johnson is accused of trying to hold up two people at gunpoint at the machine, court records said. As he was leaving, his victim got a gun from his car and ordered the robber to stop. Johnson allegedly pointed his gun at the robbery victim, who then fired at Johnson, court records said.

Clay County Prosecutor Daniel White said no criminal charges are being considered against the 61-year-old man who shot Johnson.

“It’s clear from the statement he gave police that the victim felt his life — or his wife’s life — was at risk,” White said. “He only fired when Johnson turned back toward him, gun in hand.”

“The shooting appears completely justifiable,” he said.

White said Johnson survived the gunshot and is expected to be released from an area hospital by the weekend.

Authorities said that before the attempted ATM robbery, Johnson allegedly held up the Pour Boy gas station in the 4200 block of North Oak Street Trafficway.

Just before 7 a.m. a gunman walked into the store, paced the aisles and then brandished what appeared to be a handgun. The clerk gave money to the gunman, who then fled, court records said.

I'll bet that the victim is going to rue the fact that this guy lived.

The robber wil no doubt sue the man he robbed at gun point for shooting him in self defense.

If more thieves like this were killed, fewer would look at theft as an alternative to work. The morals of this story, as I see it, are:
1. Aim better.
2. Never talk to the police in situations like this, or most any situation. You have nothing to gain, and something to lose. You don't know what all the laws are, and you don't know how the things you say will be construed. The law often has little to do with what's right. Just remain silent and get a lawyer.

Good luck to the real victims.

How did you derive this moral from that story?

Because I misread it. I thought there was still an investigation going on, and it was deemed there probably would be no charges filed. My mistake.

Still, it's good advice. This guy either feared for his life, or knew enough to say so. Some places require you to try to escape, if reasonable, before using deadly force. Now you have the whole "what's reasonable" debate, and everything you say is evidence. There are lot's of "gotchas". It's just not worth the risk.

I think the 61 year old needs to also be charged in this incident.

Didn't use enough firepower to get the job done.

What did he use? 380, 32, 25? Usually a good idea to use a caliber that starts with a 4, like a 40 S&W, 41 Magnum, 44 Magnum, 45 Auto, 45 Colt, 460 Ruger. Guess something like a 10mm, 357 SIG would work well also.

Well on the other hand, he did observe rule #1 in a gunfight. Have a gun.

Well on the other hand, he did observe rule #1 in a gunfight. Have a gun. That, he got a round off and he actually hit, which under pressure is a good thang.

I'll have to go along with "Gunny" and others in this thread.

I also think the old man should be charged,
for using an insufficient caliber.

Yeah it's a shame asshole is STILL not looking for his head! And, for anyone that can ensure that asshole IS LOOKING for his head, as a public service, I'll clean up the mess. The Guinness is on me, also. ;)
