So a question to people that may have had experience with this. I have a certified letter that basically says that I have a file on my site from my ISP that is copyrighted by FOX. My site being my ip address from my ISP. (This is not my website in my signature) I am not going to get into specifics of what file and when but I wanted to know if I did not ever have the file, or ceased the use of it as stated in the letter, Will they more than likely leave me alone or is there something to worry about.

I currently have unsecured wireless internet and am thinking that maybe someone used my internet to get stated file. As I researched DMCA I found out that this ACT is extremely one sided and basically bends anyone over that gets on the internet. But I figure some of you may have experience with this and wanted to hear some input.

I don't understand the situation. Are you saying:

1. You have a website, and there is no such file on your server, although there was at one time due to someone else breaking into your system, or

2. You don't have a website, and the letter is stating that you have downloaded a copyrighted file, which may have been done by someone else using your network.

In any case, I don't think you have any serious concerns, although media companies can be aggressive, and stupid, when they desire. You would be inconvenienced much more than them. Ignoring the letter is probably not the best approach.

I would reply stating that you have no such file on your system. I wouldn't give any more information that the minimum necessary to address the specific issue they've raised. Do it certified so that you have a record, and keep all correspondence. I think it'd be extremely unlikely you'd hear anything more, but you want to be prepared.

In response it is ....

2. You don't have a website, and the letter is stating that you have downloaded a copyrighted file, which may have been done by someone else using your network.

The way the letter is stated, my dsl modem is considered a site. It is merely a DNS name to a modem on my ISP's network.

The letter was written by the ISP not "TWENTIETH CENTURY FOX FILM CORPORATION". A fox agent has been given this letter as well to document that my ISP has done their job. I unfortunately have no address to reply to other than the corporate office of the ISP, which is right down the road from my house.

Yes, you should be concerned. The next step is a pre-settlement letter. Either they saw this file on your IP, or your IP is/was listed in one of the file sharing engines as having that file available. Two actions you should take. Lock down your AP with a WPA key, and scan your systems for viruses, etc. If you need more info, PM me.
