Be advised, I am no expert but I have a bit of knowledge in the NHTSA safety defect arena. My understanding is that, as part of the TREAD act, the Early Warning Reporting (EWR) was designed to forewarn of possible serious safety problems by providing a quantifiable record of occurrences by vehicle model and component categories, such as tires. This reporting is required of all motor vehicle manufacturers and must be submitted quarterly.

BMW should be reporting their production numbers, by model (LT, RT, etc.), to NHTSA along with the number of warranties by category and submitting information on customer complaints. BMW may not have deemed the RD failures as "safety related" and therefore chose not to consider a recall. However in the presence of customer and/or dealer complaints to NHTSA, NHTSA may choose to conduct their own investigation, including reviewing BMW's EWR reports for rates of warranties/failures compared to production numbers and decide for themselves. One has to presume that BMW is reporting the data properly.

It would seem to me that if NHTSA were to receive complaints from all the customers who have experienced the failures, they might decide to open an investigation. In that case, BMW will have to explain its decisions to the feds. NHTSA can order a recall if they think a safety defect exists.

I filed a report regarding a failure on another MC brand. When I informed that MC brand legal department I received a full "buy back" of the machine.

Ya think my report had anything to do with the amicability?
